No. Since July 1, 2024, intentionally releasing helium balloons outdoors in Florida is a littering infraction with a $150 civil penalty.
Section 379.233 of the Florida Statutes makes it unlawful to intentionally release, organize the release of, or cause the release of balloons filled with a gas lighter than air. The 2024 law (CS/HB 321) removed the old exemption for “biodegradable” balloons and the earlier limit that allowed small releases. Violations are noncriminal littering infractions under the Florida Litter Law, which sets a $150 civil penalty. The law exempts indoor releases, scientific and weather balloons released by government agencies, hot air balloons that are recovered, and children 6 years old or younger.
For a memorial, celebration or reveal, consider alternatives such as an indoor balloon drop or pop, bubbles, or planting a tree.
How do I keep balloons looking good in Florida heat?
Keep outdoor balloon decor in the shade and install it as close to party time as you can. Heat and direct sun shorten the life of balloons, and darker colors absorb more heat. Afternoon thunderstorms and wind are also common in summer.
